1. Who we are

These Terms of Use govern your use of the services operated by AZURE FLOWSTATE PRIVATE LIMITED (UEN 202615248W), a private company limited by shares incorporated in Singapore, with registered office at 68 Circular Road, #02-01, Singapore 049422 ("Azure Flowstate", "we", "us", "our").

We operate AI-driven recruitment services accessible through, among other channels, azure.msg.community, hirry.co, and WhatsApp Business messaging.

2. The services

Our services help employers ("Customers") fill open positions. The services include:

• AI-assisted refinement of job descriptions — we use AI to transform a Customer's raw job posting into a structured, candidate-attractive description.
• Agentic recruitment — autonomous AI agents source, contact, pre-qualify, and brief candidates ("Candidates") on the Customer's behalf, by voice and by WhatsApp.
• Resume delivery via WhatsApp — Candidates' resumes and interview information are delivered to the Customer's WhatsApp number.
• Conversational interfaces — Customers and Candidates may interact with our agents on our websites and via WhatsApp.

The services are not regulated recruitment agency services in jurisdictions where such regulation applies, not an employer-of-record service, and not a job board. We do not employ, represent, sponsor, or warrant any Candidate. The decision to interview, hire, or reject is solely the Customer's.

3. Acceptance

By creating an account, saving a payment method, sending us a WhatsApp message, or otherwise using the services, you accept these Terms in full, together with our Privacy Policy. If you do not accept, please do not use the services.

4. Eligibility

Customers must:

• Be a legal entity or a sole trader with capacity to contract;
• Provide accurate company information (legal name, registration number, contact details);
• Source for genuine, available positions in their own organisation;
• Not be subject to sanctions or other legal restrictions applicable to Azure Flowstate.

Candidates must be aged 18 or above.

5. AI and automated processing

You acknowledge that our services rely substantially on artificial intelligence and large language models. Our AI agents may generate or transform text (job descriptions, candidate briefs, conversation utterances), make ranking or shortlisting suggestions, and conduct conversations autonomously.

AI output may contain errors, omissions, or biases. We make reasonable efforts to monitor and improve quality, but:

• AI-generated text is suggestive, not authoritative. Customers are responsible for reviewing job descriptions before they are published.
• Candidate shortlists and ratings are decision-support, not decisions. Customers retain full responsibility for hiring decisions.
• Conversations conducted by our agents are recorded and may be reviewed for quality, training of human staff, and product improvement.

6. Use of the services

You agree to:

• Provide accurate and up-to-date information;
• Use the services in good faith and only for their intended purpose;
• Not transmit content that is unlawful, defamatory, harassing, or contrary to public order;
• Not state hiring criteria that discriminate on grounds prohibited by applicable law (race, religion, gender, sexual orientation, age, disability, national origin, and any other protected ground);
• Not misrepresent the role, salary, or working conditions;
• Not impersonate any other person;
• Not reverse-engineer, scrape, or otherwise interfere with the platform or its AI components;
• Respect Azure Flowstate's intellectual property rights.

7. Fees

Pricing applicable to a specific product (including the Hirry product) is set out in the dedicated terms for that product. See, for example, the Hirry Terms of Service for the Hirry candidate-delivery product.

Where no dedicated terms apply, the services are provided free of charge unless otherwise agreed in writing with the Customer.

8. WhatsApp and voice channels

As part of the services, our agents may contact Customers and Candidates by phone and by WhatsApp Business. By using the services, you accept being contacted via these channels for service-related purposes. Calls may be recorded for quality and audit, in accordance with applicable law.

Use of the services also implies acceptance of WhatsApp's own terms. Azure Flowstate is not responsible for the practices of Meta Platforms, Inc. with respect to the WhatsApp platform. See WhatsApp Terms.

9. Intellectual property

The platform, its software, content, brand, scripts, prompts, model adaptations, and templates are the exclusive property of Azure Flowstate or its licensors and are protected under applicable intellectual property laws, including the Copyright Act 2021 of Singapore. Any reproduction, representation, or distribution, in whole or in part, without our express written consent is prohibited.

AI output generated for a Customer in connection with that Customer's job postings (refined job descriptions, candidate briefs prepared for that Customer) is licensed to the Customer on a non-exclusive, non-transferable basis for use in that Customer's hiring activities, subject to payment of any applicable fees.

10. Personal data

The processing of personal data (of Customers, their representatives, and Candidates) is governed by our Privacy Policy, which forms an integral part of these Terms and complies with the Singapore Personal Data Protection Act 2012 (PDPA) and, where applicable, with the EU GDPR.

11. Warranties and liability

The services are provided "as is" and "as available". To the maximum extent permitted by law, Azure Flowstate disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Azure Flowstate shall not be liable for:

• Interruptions or malfunctions of the WhatsApp platform or any third-party infrastructure;
• Decisions made by Customers in reliance on AI-generated output;
• Loss of profits, business, or data;
• Indirect, incidental, consequential, special, or punitive damages.

Our aggregate liability for all claims arising from your use of the services shall not exceed the greater of (a) the amounts paid by you to Azure Flowstate in the twelve (12) months preceding the claim, or (b) SGD 500.

12. Termination

You may stop using the services at any time. We may suspend or terminate access immediately for breach of these Terms, fraud, abuse, non-payment, or if continued provision becomes legally or operationally impracticable.

13. Changes

We may modify these Terms at any time. Changes take effect upon publication, except where law requires a longer notice period. Continued use of the services after a change constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Singapore.

Any dispute arising out of or in connection with these Terms shall be referred to and finally resolved by the courts of Singapore, which shall have exclusive jurisdiction. The parties shall first attempt to resolve any dispute amicably.
